Earlier this year, Caitlyn Jenner‘s Malibu car crash left one person dead. A spokesperson for the Los Angeles County Sheriff’s Depart said that Caitlyn Jenner has a 50/50 chance that she will be charged.

In fact, Caitlyn Jenner is facing some serious jail time if she is convicted for misdemeanor manslaughter. But, Caitlyn Jenner is not like most people. The reality star recently transitioned from a man to a woman, so it begs the question – where would Caitlyn Jenner serve jail time if convicted of misdemeanor manslaughter?

In a recent report by TheWrap, journalists Debbie Emery and Pamela Chelin asked just that and the answer is pretty surprising.

“A transgender person who has not made the transition physically will be assigned to the prison of their genetic birth gender, while those who have had reassignment surgery will generally go to the prison of their reassigned gender,” attorney Marvin Putnam, a partner in the international firm of O’Melveny & Myers, told TheWrap, so “a woman born in a man’s body will go to a male prison,” and vice versa.

But, because Caitlyn Jenner is a celebrity, expect the reality start to have special arrangements.

Due to Jenner’s unique circumstances, “I am sure for her safety they will make special arrangements and keep her out of gen pop [general population], depending on what she is doing medically. They couldn’t do anything that would hurt her or just cut off her treatment,” personal injury attorney Kevin Boyle of Panish Shea & Boyle continued.

However, it is important to note that Jenner has not publicly revealed whether she has undergone gender reassignment surgery yet or if she plans to have the operation.
