Truck Driver Who Hit Tracy Morgan’s Limo Had Not Slept in 24 Hours

Kevin Roper, the Walmart truck driver who drove into the back of a limo carrying Tracy Morgan early Saturday Morning, had not slept in at least 24 hours by the time of the accident.

According to police reports, Kevin Roper was awake for at least 24 hours when he drove into Tracy Morgan’s limo killing one passanger and putting Tracy Morgan into the hospital.

The accident left Tracy Morgan with several injuries, including a broken leg, broken femur, broken nose and broken ribs-and comedian James McNair dead.

Tracy Morgan was in surgery on Sunday and remains in critical condition, Morgan was in surgery on Sunday and remains in critical condition, but his publicist is more responsive.

Kevin Roper, after posting $50,000 bail this weekend will appear in court Wednesday. He is being charged with death by auto for killing McNair and four accounts of assault by auto.

Walmart president recently said in a statement that the company “will take full responsibility” if it’s ruled that Walmart’s truck caused the accident.

Truck-driving regulations enforce a certain number of hours a truck driver must drive before taking a break. New limits were recently imposed enforcing longer rest periods of truck drivers. According to MSNBC, “the new rules also limit the maximum average work week for truck drivers to 70 hours, a decrease from the previous maximum of 82 hours, and require drivers to take a 30-minute break during the first eight hours of a shift.”

It is not clear yet, if Kevin Roper disobeyed these regulations, or if Walmart enforces longer driving periods without rest for their truck drivers.
